Vorgathium's services are powered by fine-tuned AI models built upon Google's Gemini foundational model. Services are provided "as is" without warranties of any kind.

3. User Eligibility and Registration

Age Requirement: You must be at least 13 years old (or the applicable age of digital majority in your jurisdiction) to use Vorgathium's Services. Users under 18 should have parental consent. By using our Services, you represent and warrant that you meet these age requirements.

Account Registration: To access certain Services, you may need to create an account. You agree to:

• Website design and user interface
• Documentation and educational materials

User-Generated Content: You retain ownership of any content you create, upload, or submit to Vorgathium ("User Content"). By submitting User Content, you grant Vorgathium a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and distribute your content for improving our Services and fine-tuning our AI models (subject to anonymization and privacy protections).

Limited License: We grant you a limited, non-exclusive, revocable license to access and use our Services for personal, non-commercial purposes. This license does not permit you to transfer, copy, modify, or distribute our Services.

6. User Content and Responsibilities

You are solely responsible for any content you create, upload, or transmit through Vorgathium's Services. You warrant that:

AI Output Disclaimer: Vorgathium's AI is built on fine-tuned Google Gemini models. While we strive for accuracy, AI-generated responses may contain errors, biases, or inaccuracies. You should:

• Independently verify all critical information
• Not rely solely on AI recommendations for legal, medical, or financial decisions
• Report inaccuracies or harmful content to our support team

8. Payment and Billing

Pricing: We reserve the right to change our pricing with 30 days' notice. Changes will not apply to existing subscriptions until the next renewal.

Billing: You authorize us to charge your payment method for subscriptions and services. You agree to provide accurate billing information and notify us of any changes.

Refunds: Refund policies are determined by subscription type. Requests must be submitted within 30 days of purchase. Refunds are processed within 10-15 business days.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellations are effective at the end of the current billing cycle.

9. Limitation of Liability

Disclaimer of Warranties: VORGATHIUM SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, VORGATHIUM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Maximum Liability: Our total liability for any claim arising from these Terms or your use of Services shall not exceed the amount you paid to us in the past 12 months, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Vorgathium and its officers, directors, employees, agents, and licensors from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your violation of these Terms; (b) your use of our Services; (c) your User Content; or (d) your violation of any laws or third-party rights.

11. Termination of Service

Vorgathium may terminate or suspend your account and access to Services immediately and without notice if you:

• Engage in harmful, abusive, or illegal behavior
• Fail to pay for services when due
• Pose a security or legal risk to Vorgathium or other users

You may terminate your account at any time by contacting us. Upon termination, your User Content may be permanently deleted.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Vorgathium regarding your use of our Services. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
